Our Town and Sacramento Arts: Terms of Use

Your use of the Our Town or Sacramento Arts service will be subject to the following terms and conditions:

1. Upon approving this agreement, you will be allowed into the "Online Editor" program, which will enable you to post and update information on your group's web page freely. The security factor is the password you've chosen, which should be held in strict confidence by you and your organization.

2. The Service is provided at no charge to you.

3. You agree that you shall have no ownership interest in the Service, including its content and the software used in operating the Service.

4. The Sacramento Bee shall have the right to edit all content posted on the Service in its sole discretion at any time.

5. You understand and acknowledge that the Service may be terminated at any time by The Sacramento Bee, with or without notice. In addition, the Sacramento Bee may terminate your right to participate in the Service at any time, if the Sacramento Bee determines in its discretion that the content being provided by you is inappropriate or inadequate for use in the Service, or that you otherwise do not qualify for participation.

6. You understand and agree that all content provided by you for the Service shall become the property of The Sacramento Bee at the time that the content is posted by you on the Service. The Sacramento Bee shall have all rights of ownership to the content, including all copyrights, for all purposes. By clicking acceptance of this agreement, you agree to assign to The Sacramento Bee, irrevocably and perpetually, the copyright in the content provided by you to the Service. By clicking acceptance, you represent that the use of the content you provide to the Service, and the assignment of all rights in the content to The Sacramento Bee, shall not violate any law or infringe upon the copyrights, trademarks, trade names, patents or proprietary or other rights of any other person, firm or corporation and that such content contains no matter which is libelous, an invasion of privacy, an unlawful appropriation of the name or likeness or is otherwise injurious to the rights of any other person, firm or corporation.

7. You agree to indemnify and hold The Sacramento Bee harmless against any claims, demands, causes of action, judgments, costs or expenses arising out of or related to any suit, claim or proceeding by any third party based upon (1) your breach of any representation or agreement under this agreement, (2) an allegation that the use of the content on the Service or its assignment to The Sacramento Bee infringes a copyright or other right of any third party, or (3) an allegation that The Sacramento Bee caused harm to any person or organization based upon the information contained in the Service, or failed to provide the services contemplated by this agreement. We reserve the right to defend any such claim, and you agree to provide us with such reasonable cooperation and information as we may request.

8. You additionally agree to indemnify and hold Waveshift Technologies, Inc. (the entity that owns the software used in the Service and hosts the Service) harmless against any claims, demands, causes of action, judgments, costs or expenses arising out of or related to any suit, claim or proceeding by any third party alleging that Waveshift caused harm to any person or organization based upon the information contained in the Service's content, or based upon any failure of Waveshift to meet its obligations under its Web Hosting Agreement with The Sacramento Bee. Waveshift is a third party beneficiary of this agreement for purposes of this Section 8.

9. The Service is provided on an "as is" basis. WE MAKE NO WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR WARRANTIES REGARDING THE ACCURACY, AVAILABILITY, RELIABILITY, SECURITY OR COMPLETENESS OF THE CONTENT OR ANY OTHER SERVICE OR PRODUCT ON OR RELATED TO THE SERVICE (INCLUDING ANY OUTSIDE RESOURCE TO WHICH THE SERVICE MAY LINK). You agree that the use of the Service is at your sole risk.

10. You hereby represent that your principal place of business is located in one of the following counties: Sacramento, Yolo, Placer or El Dorado.

• Our Town's purpose is to serve local not-for-profit community groups. (Arts groups are welcome here as well.)



• Sacramento Arts' purpose is to serve the local arts community.

You must accept these terms before you can advance to the signup form.
